Surveillance footage released Tuesday appears to show Tyrone Harris, the 18-year-old who allegedly fired at officers in Ferguson Sunday evening, holding a gun, police say.

According to CNN, the man in the footage can be seen running with other people near West Florissant Avenue after multiple shots rang out. The individual, who was wearing the same red shorts as Harris, can be seen pointing what appears to be a gun towards the ground. Family members claim it could be a case of mistaken identity, while friends have said the opposite.

Tyrone Harris Sr. says his son was present during the protests on the anniversary of Michael Brown’s death, but maintained his friends encouraged violence and he was simply caught in the middle of it.

“From what I heard, he was there with some friends and they had a confrontation. They start shooting at the friends, and he just happened to be at the wrong place at the wrong time,” Harris’ father, Tyrone Harris Sr., told CNN affiliate KMOV.

Harris, who attended school with Brown at Normandy High, is a recent graduate. His aunt also supported Tyrone Harris Sr.’s claims, but an eyewitness told CNN a different story.

“Tyrone was right next to me. He was shooting back at them and all that. … And police shot back at him,” 18-year-old Seth Norfleet said.

Harris is being charged with four counts of first-degree assault on law enforcement, five counts of armed criminal action, and one count of discharging a firearm at a motor vehicle. He is currently recovering from multiple gun shots at a local hospital.

Authorities are working on lifting the state of emergency issued Monday after the violence broke out.
